Summary of Terms and Conditions
Please read carefully. Payment of initial deposit is considered acceptance of these terms and conditions.
Deposits and Accommodation payments
Deposit of 50% of the rental is required to secure the booking. This is non-refundable unless the property can be re-booked. The balance of the rental and the security bond is required 21 days prior to the commencement of the stay.
Cancellations
If caused by the client, rental monies paid are not refundable unless the property is re-let for the entire period. If a refund is made due to the property being re-let, a $200 cancellation fee will apply. The owner will make every effort to ensure the property is available as booked. However, the owners reserve the right to make alterations to bookings due to unforeseen circumstances. In the event of a natural disaster, war, pandemic or force majeure, there is an option to re-book later subject to availability
In line with industry policies in the Byron area, our covid19 cancellation policy is that if there is a travel ban in place which restricts you from attending your booking then we will place the value of your deposit into credit for use within 12 months of the travel ban being lifted – this is transferrable to friends and family. In the event Byron Bay is listed by the NSW Government as a hotspot and a NSW travel ban is imposed for the time applicable to the booking, we will offer a refund or credit for the booking. Anything outside of a cancellation under a travel ban is only covered by our standard policy.
We strongly recommend that you have travel insurance to cover you in the event of an unforeseeable cancellation. If, due to travel restrictions or a change of circumstance, the owner needs to cancel the booking, there will be a full refund.
Conditions of Occupancy
The maximum adult persons permitted to occupy the house is 8. Additional persons may be permitted by prior arrangement, an extra fee may apply. All persons staying at the property must be listed on the booking confirmation form. No other additional persons may stay at any time unless authorised by the owner.
Functions/Events
The premises are let for holiday rental only.
Byron Shire Council has imposed a noise curfew on the area. No live bands, DJ’s, microphones or amplifiers are allowed, and music must finish at 9pm. After that the house music system can be employed for low background music only. If music/guests continue to make noise above these limits after 9pm, a deduction will be made against the bond. If a complaint is received concerning guest conduct, a warning will be issued. A second visit or complaint will result in instant eviction with loss of remaining rent and bond.
Outside caterers and chefs are welcome for functions but must be pre-approved by the owner. A list of pre-approved ones are available on request
Bonds
The minimum bond is $2000 and will be refunded in full if the property is left in the same condition as it was at the start of the tenancy. Allow up to 7 days for the processing of the refund after the housekeeper has inspected and confirmed the condition. Please refer to the other sections of this document where possible deductions from the bond may occur. Special attention to any evidence of smoking, cleaning and rubbish removal should be made. If deductions to your bond refund are made, no discussion will be entered into regarding these.
Check In / Check Out
The premises are available from 3pm on the day of arrival and are to be vacated by 10am on the day of departure. This may be flexible when other groups of guests are not scheduled to be in residence but must be approved. The House Manager will meet guests on arrival and departure. Late check out will incur a fee of $100/hour unless prior agreement has been made.
Cleaning and Linen
All bookings include a standard cleaning and linen service, including bathroom and beach towels. The premises are to be left in a clean and tidy state with dishwasher run and emptied and all other dishes put away in correct cupboards. The BBQ must also be left clean and waste holder emptied. Failure to do so will incur an extra cleaning charge (deducted from bond) based on the extra hours it takes for the cleaners to complete. Sand throughout the house or pool is considered “excess”. Extra washing, dry cleaning or replacement of linen required due to damage or staining will be charged to the tenant. For stays of 2 weeks or more, the house can be cleaned mid-stay or weekly as part of the service. Extra cleans can also be booked for $400 + linen costs.
Breakages/Damages/Losses
Please advise owner or housekeeper immediately of any breakages, damage or losses to property furnishings or fittings and these must be paid for by the tenant. Should a tenant discover a maintenance issue, default or breakage, please, on arrival advise owner who will endeavour to have it corrected. While every effort will be made, no guarantee of immediate repair can be made, especially during peak holiday periods due to non-availability of tradespersons or parts. There will be no refund or discounts deducted for appliances or items awaiting repair. No responsibility is taken for tenant’s personal property lost, stolen, damaged, or left on the premises
General
The premises are listed and let in good faith, so no refund is given if you are unsatisfied for some reason. Also, please remember Pavilion 4 is fitted out with high quality fixtures and fittings which must be respected during your stay. In particular, the bathrooms are tiled with natural stone which is a porous material. Consequently, some products, in particular hair dyes, will stain or bleach the tiles which you, as the guest, will be liable for. Please note that due to the polished timber floors, stiletto heels are not to be worn during your stay. Also be careful and lift, not drag, furniture if you need to move it for any reason as rectification for scratches on the floors will be payable by guests. Finally, be aware that when wet, the large decks often become slippery so please take care.
Keys
The House Manager will provide keys on arrival and collect on departure. If keys or remotes are lost or misplaced, a call-out fee of $120 will be charged plus replacement costs. If keys are permanently lost, for security reasons, all locks will be replaced at the cost of the tenant. NOTE – key replacement is a high-cost item.
Noise
Please be aware and respectful of neighbours and restrict excessive noise. Byron Shire Council has also imposed a strict noise curfew on the area after 9pm. If you have guests visiting you at the property at any time, please ensure they leave quietly before 9pm so as not to disturb adjoining properties. All outdoor socializing needs to be taken inside with closed doors at 9pm. Failure to comply with the 9pm noise curfew will result in a deduction in your bond refund and possible eviction. If guests from adjoining properties make any complaints and security is called, their $150 call out fee will be deducted from your bond. In addition, we cannot be held responsible for any noise, construction or otherwise, occurring close to the property. If this continues, however, please call HLO Security on 02 6626 6888 or advise the owner so it can be investigated.
Parking
Car parking is available for guests staying in Pavilion 4 only. There are two car parks in the garage and there is parking at the rear of the property with direct access to Broken Head Rd suitable for up to 3-4 vehicles. There is no parking on the driveway on the west side of Pavilions 4, this is a fire trail and offending vehicles will be removed. Guest parking is also available at the front of Pavilions. There is no parking anywhere on the internal driveways or on the fire trails. All function guests must travel to and from the house by pre-booked taxi or pre-arranged bus.
Parties
No parties are permitted and if this condition is breached then the owner has the right to end guests’ tenancy immediately without refund of rent or bond.
Pets
House trained pets are only allowed with the permission of the owner. As we back onto protected rainforest, cats are not permitted. Please note that as Broken Head is a National Park, no dogs are allowed anywhere in the National Park or on Broken Head beach. Any damage or mess left in the house or garden will incur an additional cleaning fee.
Pool
Please enjoy the pool and swim safely but be aware of the following rules:
- Children must be supervised at ALL times
- Pool hours between 7am and 9pm. Please respect neighbours with regard to noise.
- Please SHOWER before entering the pool to ensure you have washed all sand and sunscreen off
- No GLASS in pool enclosure
- No DIVING of any kind including bomb diving
- It is unsafe to swim under the influence of alcohol or any other drug
- Pool settings are not to be changed
We usually schedule maintenance on days when no guests are in residence however sometimes this cannot be avoided and the property gardens and pool may need to be maintained during your stay.
Rubbish and Recycling
Byron Bay has a 3 bin collection service for recycling (yellow) and general waste(red) and compost (green) – contaminated bins will not be collected and will incur a processing cost. All bins for Pavilion 4 are in the gated area to the rear of the property. Please ensure all rubbish is placed in bags in red-lidded bin and recycling – bottles, paper -in yellow-lidded bin prior to departure. Please place all frozen seafood/eat scraps in the red-lidded bin on the day of collection. The bin lids must be able to close for collection.
Contractor will place bins out for council collection Monday afternoon and return clean after collection Tuesday morning. Note the yellow bin is collected fortnightly.
Please ensure any additional rubbish is removed from within the bin enclosure or inside Pavilion 4 otherwise an additional cleaning fee will be charged. Rubbish2move can be contacted on 0439 876 399 if you require rubbish removal
Smoking
Please remember Pavilion 4 is a non-smoking property and any evidence of smoking within the gated area of Pavilion 4 (including butts in the garden) will incur an additional cleaning fee deducted from the bond.
Visitors
The curfew for guests not staying at the property is 9pm. Please ensure they leave quietly so as not to disturb adjoining properties.
Wildlife
Please beware of local wildlife that are often around in the bush style setting of Pavilions. As we are so close to the tea tree lakes, we get very few midges or mosquitoes but, in case there are a couple, we have left citronella candles and coils. Please, if you use these be careful to place them in an appropriate place so as not to burn anything.
NB: Excessive noise, drunk and disorderly behaviour will not be tolerated at any time and may result in immediate termination of tenancy with no refund.
** Pavilion 4 is registered with HLO Byron Bay which is a 24hour security company that attends any noise infringements. You or neighbours can call their hotline on (02)6626 6888. The complaint is immediately directed to the Police or a security guard. If a call out needs to be made to Pavilion 4, the call out fee will be deducted from your bond.
